Definitions

Business days - from Monday to Friday, except public holidays;

Product card - a single subpage of the store containing information about a single product;

Civil Code - Act of 23 April 1964. (Journal of Laws No 16, item 93, as amended);

Consumer - a consumer within the meaning of the Civil Code;

Account - the part of the Shop allocated to a given Consumer, with the help of which the registered Consumer may carry out activities specified in the Shop;

Shopper - a natural person having at least limited legal capacity, a natural person conducting business activity, a legal person or an organizational unit without legal personality;

Product - minimum and indivisible quantity of the item that can be the subject of the order, and which is given in the Seller's shop as a unit of measure when determining its price (price/unit);

Terms and Conditions - these Terms and Conditions;

Shop - Sleepdo.eu online shop run by the Seller at https://sleepdo.eu;

Seller - Małgorzata Pawlik conducting business activity under the company Pracownia Krawiecka Małgorzata Pawlik with its registered office at 30 Wesoła Street, 42-202 Częstochowa, Polska entered into the Central Register and Information on Business Activity conducted by the Minister of Economy, no. REGON [business statistical no.] 150270163, no. NIP [tax id. no.] 9490497170;

Deadline - number of hours or working days specified on the product card;

Contract - an off-premises or remote contract within the meaning of the Act on Consumer Rights of 30 May 2014 in the case of Consumer and a sales contract within the meaning of Article 535 of the Civil Code Act of 23 April 1964 in the case of Buyers.

Consumer Rights Act - Consumer Rights Act of 30 May 2014 (Journal of Laws 2014, No. 827);

Act on the provision of services by electronic means - Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws No. 144, item 1204 as amended);

Order - a declaration of will of the Buyer submitted through the shop specifying unambiguously: type and quantity of products; form of delivery; form of payment; consumer's data; aimed directly at concluding an Agreement between the Buyer and the Seller.

Technical requirements

For the proper functioning of the Shop, you need a device with Internet access with a bandwidth of at least 256 kbit/s and a web browser with a minimum of Internet Explorer 8 or Chrome 16 or Firefox 10 or Opera 11 or Safari 5 or newer, which supports JavaScript and accepts cookies.

To place an order in the Shop, in addition to the requirements set out above, an active e-mail account is required.

 

Online shopping

Orders in the Shop can be placed 24 hours a day.

In order to place an order, the consumer should add the Product(s) to the basket, choose the form of delivery and the payment method, provide the data necessary to complete the order, accept the Terms and Conditions and place the order by using the "Buy and pay" button.

Prices of goods visible in the Shop are total prices for the goods, including VAT.

The total order price consists of the Product(s) price and, if applicable, the cost of delivery.

Placing an order is the same as concluding a sales contract between the Consumer and the Seller.

Payment for the order placed takes place, depending on the form chosen by the consumer, through the electronic payment operator integrated with the Shop or through a payment card or traditional bank transfer.

The operators of electronic payment integrated with the Store are PayPal.com, BlueMedia S.A. and Przelewy24.pl.

By making purchases in the Shop, the Consumer accepts the use of electronic invoices by the Seller. The Consumer has the right to withdraw his acceptance.

The Consumer may create an Account in the Shop or make purchases without creating an Account.

 

 

Delivery

The Consumer shall be obliged to execute the Order without defects.

The delivery date of the Order is always specified in the Product Card.

If the Consumer has chosen to pay for the Order by electronic transfer, the Seller shall proceed to execute the Order after the payment is credited to his bank account.

If, under one Order, the Consumer has purchased Products with different delivery dates, the Order shall be executed on the date appropriate for the Product with the longest delivery date.

Delivery of Orders purchased in the Store is carried out on the territory of Poland and the Member States of the European Union, excluding Cyprus and Malta.

Orders are delivered through a delivery company.

 

Right of withdrawal

The Consumer may withdraw from the Contract without providing any reason by making a statement to that effect within 14 days. In order to meet this deadline, it is sufficient to send a statement by mail or e-mail before its expiry. The Consumer may formulate the statement independently or use the model statement of withdrawal from the Agreement. The declaration is Attachment No. 1 to the Regulations. The 14-day period begins on the day on which the Order is delivered. Returned goods should be sent immediately, but not later than within 14 days from the date of sending the statement of withdrawal from the contract.

In case of withdrawal from the remote Agreement, the Agreement is considered not concluded. The Consumer shall return the Product in the original condition, unless the change was necessary in order to determine the nature, features and functionality of the ordered Product. The return should be made immediately, not later than within 14 days. The order should be sent to the address of the Seller. The cost of sending back the Product is borne by the Consumer.

The Seller shall immediately, but not later than within 14 days from the date of receipt of the Consumer’s statement of withdrawal from the Agreement, return all payments made by the Consumer for the Product(s), including the costs of delivering the Order. The Seller shall make the return of payment using the same payment method as used by the Consumer, unless the Consumer consents to another means of return, and this method shall not involve any cost to the Consumer. The Seller may withhold the return of payments received from the Consumer until the moment the Product is received back or the Consumer provides evidence of its return, whichever occurs first.

The right to withdraw from a remote contract shall not apply to the Consumer with regard to the contract:

where the benefit is provided for an item that is non-prefabricated, manufactured to the Consumer’s specifications or to meet his individual needs,

in which the object of the service is an item that is rapidly deteriorating or has a short shelf life,

in which the object of the service is an item delivered in sealed packaging which cannot be returned due to health protection or hygienic reasons if the packaging was opened after delivery,

in which the object of the service is items which, by their nature, are inseparably connected with other items after delivery,

in which audio or visual recordings or computer programs are provided in sealed packaging if the packaging is opened after delivery,

for the supply of newspapers, periodicals or magazines, except for the subscription agreement,

where the price or remuneration depends on fluctuations in the financial market over which the trader has no control and which may occur before the withdrawal period expires

in regards to the supply of digital content which is not recorded on a tangible medium if performance has begun with the consumer's express consent before the end of the withdrawal period and after the trader has informed him of the loss of the right of withdrawal.

 

Complaints

Any item purchased in the Store may be submitted for complaint within the relevant terms and conditions if it has defects that make it incompatible with the Sales Agreement, on the basis of the warranty regulated in the Civil Code.

If the Product purchased by the Consumer is inconsistent with the Agreement or has defects, it should be notified to the Seller and delivered to its address.

Complaints should be submitted in writing by sending the necessary statement by traditional mail or by e-mail. The message should contain the e-mail address, date and type of occurrence of irregularities and contact details.

The complaint shall be considered no later than within 14 days from the date of receipt of the Product under complaint.

In the case of a valid complaint, the Seller shall return to all payments made by the Consumer for the Product(s), including the costs of delivery .

Complaints related to the provision of electronic services through the Store should be submitted to the Seller's e-mail address.

In the event that the complaint procedure is not accepted, the Consumer may take advantage of, among other things:

mediation conducted by the locally competent Provincial Inspectorate of Trade Inspection, to which a request for mediation should be addressed - the list of Inspectorates can be found here: https://www.uokik.gov.pl/wazne_adresy.php#faq595,

the assistance of a locally competent, permanent consumer arbitration court operating at the Voivodeship Inspectorate of Commercial Inspection, to which an application should be submitted for consideration of a case before an arbitration court - the list of courts is available at the address: https://www.uokik.gov.pl/wazne_adresy.php#faq596,

free help from the municipal or district consumer advocate,

the online ODR platform available at the address: http://ec.europa.eu/consumers/odr/.

 

Personal data

Personal data provided by the Consumer is collected and processed by the Seller in accordance with applicable laws and in accordance with the Privacy Policy, available in the Privacy Policy tab.

 

Final provisions

Polish law shall apply to the Agreement for the sale of Products in the Store.

In matters not regulated by these Regulations, the provisions of the Civil Code or other laws applicable to the operation and functioning of the Store shall apply accordingly.

The competent court for resolving disputes shall be the common court of local jurisdiction according to the applicable regulations.

Each Consumer has the opportunity to obtain, reproduce and record the content of the Terms and Conditions.
